Terms of Service

1. Acceptance of Terms

By accessing aian.app, creating an account, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree with any part of these Terms, you must stop using the website immediately.

There is no minimum age to use the Service. Users under 16 may only create an account with the consent and supervision of a parent or legal guardian; creating an account constitutes confirmation of that consent. Parents or guardians are responsible for their child's use of the Service.

2. User Content and Licensing

Ownership: You retain ownership of the content you create on aian.app, including flashcard sets, terms, definitions, notes, and similar content ("User Content").

License to the platform: When you set a flashcard set to Public, you grant aian.app a free, non-exclusive, worldwide license to store, display, copy, reformat, and share that content with other users of the website for learning purposes. This license ends when you switch the set back to Private or delete it, except for copies other users have already lawfully made.

New flashcard sets are Private by default. Only you can see a private set.

Your commitments: When uploading or publishing content, you represent that:

• You are the author of the content, or you hold all rights and licenses required to share it.
• The content does not infringe any third party copyright, trademark, or other intellectual property right, for example by copying copyrighted textbooks verbatim, unreleased exam questions, or paid materials.
• The content is lawful and does not violate Section 4 of these Terms.

You are solely and fully legally responsible for your User Content, including any claims arising from it.

3. Copyright and Takedown Policy

aian.app respects intellectual property rights and handles copyright infringement notices in accordance with the Intellectual Property Law of Vietnam and the principles of the U.S. Digital Millennium Copyright Act (DMCA).

If you are a rights holder (or authorized to act on their behalf) and believe content on aian.app infringes your rights, please submit a notice following the instructions on our Copyright page (aian.app/copyright).

Upon receiving a valid notice, we may hide or remove the reported content without prior notice and inform the uploader where possible. The uploader may respond if they believe the content was removed by mistake.

Accounts that repeatedly infringe copyright may be permanently terminated.

4. Prohibited Conduct

When using the Service, you must NOT:

• Use automated tools (bots, crawlers, spiders, scrapers, etc.) to collect data from aian.app without prior written permission.
• Upload pornographic, violent, hateful, discriminatory, abusive, or otherwise unlawful content.
• Upload content that infringes the copyright, trademark, or other intellectual property rights of third parties.
• Attack the system, distribute malware, exploit vulnerabilities, overload the service, or attempt to reverse engineer the website.
• Impersonate others, or share, buy, or sell accounts for profit.
• Abuse AI features to generate unlawful content or fraudulently bypass usage limits.

5. Platform Rights

aian.app reserves the right to:

• Refuse, edit, hide, or remove any flashcard set or content without prior notice if it appears to violate these Terms or is the subject of a complaint.
• Suspend or terminate accounts that violate these Terms.
• Modify, suspend, or discontinue any part or all of the Service.

All source code, user interface (UI/UX), branding, the aian.app logo, and learning materials compiled by aian.app are owned by aian.app. You may not copy or use them for commercial purposes without permission.

6. Disclaimer of Warranties

The Service is provided "as is" and "as available". We do not guarantee that the Service will be uninterrupted or error-free, or that any content is accurate.

User-generated and AI-generated content may contain errors. Please verify it yourself before relying on it for exams or work.

7. Limitation of Liability

To the maximum extent permitted by law, the owner of aian.app shall not be liable for any direct, indirect, incidental, or consequential damages, including loss of data or economic loss, arising from the use of or inability to use the website.

8. Changes to Terms and Governing Law

We may modify these Terms at any time. The latest update date is shown at the top of this page. Your continued use of the website after the Terms are updated constitutes acceptance of the changes.

These Terms are governed by and construed in accordance with the laws of the Socialist Republic of Vietnam.
